Judge stays fines, upholds license revocations

Two pharmaceutical wholesalers were granted some relief Tuesday when a judge blocked the Nevada State Board of Pharmacy's order that they be fined for violating state regulations. However, the judge upheld the Board of Pharmacy's decision to revoke their licenses.
Judge Jennifer Togliatti told Dutchess Business Services Inc. and Legend Pharmaceuticals Inc. that she was not authorized to override the Board of Pharmacy's decision to revoke the companies' licenses for an undetermined amount of time. But, she said both companies could postpone paying hefty fines until a judicial review hearing concludes in Clark County District Court.
Togliatti approved the postponement of about $1.4 million in fines for Dutchess and about $408,000 for Legend.
She also said the Board of Pharmacy could not go after the company owners' personal money in the meantime.
The wholesalers were found guilty of 11 charges including falsifying records. Dutchess was also found guilty of selling counterfeit drugs.
