Defect suit ends in $8 mil. settlement

The condominium owners of the 219-unit Pacific Legends East complex in Las Vegas have reached an $8 million settlement with the complex's developer, Pacific Homes, for alleged construction defects including overly moist soil and leaky windows.
Nancy Quon, an attorney for the Pacific Legends East Condominium Associates, said the concrete slabs the units were built on were not designed to resist the soil. She said other defects at the complex included burst pipes, water intrusion and mold in the units.
Quon said the condo owners have already had to make hundreds of thousands of dollars worth of repairs and 11 families had to move for repairs to be completed.
Jeff Garofalo, an attorney for Pacific Homes, said the settlement is not an admission of guilt.
"This case was vigorously disputed and ultimately settled after four years of litigation for a fraction of the plaintiffs' initial demand without any admission of liability on the part of Pacific Homes," he said.
