Home builder’s suit dismissed

A judge Wednesday dismissed a home builder's defamation lawsuit against the homeowners' group Safe Homes Nevada.

Clark County District Judge David Wall ruled that a statement and list on Safe Homes Nevada's website concerning construction defects falls within the state's fair reporting privilege. Wall also rejected what D.R. Horton's attorney called the builder's Strategic Lawsuit Against Public Participation, or SLAPP, suit.

Safe Homes Nevada's website had listed D.R. Horton as a builder that failed to respond to complaints about alleged defects in its homes. That information came from a state report. But D.R. Horton said the information and a statement suggesting it didn't respond to complaints was false, prompting Safe Homes to remove it from its website.
