Trademark lawsuit over Energizer Bunny settled

ST. LOUIS -- Energizer Holdings Inc. settled a lawsuit that alleged trademark and copyright infringement against two Arizona organizations that Energizer said illegally used their Energizer Bunny icon.

A company spokeswoman said settlement terms aren't being disclosed.

The settled suit alleged that a partnership between Turf Paradise and American Greyhound Racing used a likeness of the trademarked Energizer Bunny in a political mailer sent to Arizona voters in opposition of Proposition 202, a gambling expansion ballot initiative that passed on Nov. 5.

The suit was originally filed in October by Energizer's operating subsidiary, Eveready Battery Co. The spokeswoman said the company does not expect to report any suit-related charges. The lawsuit, filed in an Arizona federal court, also claimed trademark dilution and unfair competition.
