Groups settle lawsuit over dust buildup

Del Webb Communities Inc. and the Environmental Protection Agency have come to a settlement in a federal lawsuit over dust emissions coming from the developer's sites in Clark County.

The settlement of the case, originally filed in September 2001, calls for the developer to pay $50,000 in civil penalties to the government for "fugitive dust emissions."

The agreement also mandates that Del Webb project managers must complete a Clark County Department of Air Quality dust control course, monitor development sites and utilize gravel and water to cut down on dust buildup.

The parties have stipulated that further buildup of dust and violation of county dust regulations caused by movement of soil, vehicles, equipment or blasting will result in a fine of $1,000 a day.
