Document backs allegation

Monday, Jan. 27, 2003 | 11:03 a.m.

DETROIT -- Daimler-Benz AG had a plan to take over Chrysler Corp. in 1995, providing evidence that the German automaker had no intention of forging a "merger of equals" when it bought Chrysler three years later, the Detroit News reported, citing a court document.

Investor and casino mogul Kirk Kerkorian, who owned 14 percent of Chrysler, and other investors are using the document to support their case that they wouldn't have backed the transaction had they known Daimler-Benz would control the combined company. Daimler-Benz and Chrysler publicly called the transaction a "merger of equals."

Kerkorian's Tracinda Corp. and other shareholders sued DaimlerChrysler AG in November 2000, alleging the world's fifth- largest automaker lied to win support for its $35 billion purchase of Chrysler.
