ACLU representing protesters

The American Civil Liberties Union is representing eight anti-nuclear protesters arrested and charged with trespassing and obstruction after a demonstration at the Nevada Test Site.

Justice of the Peace Bill Sullivan of Beatty set eight separate trials over four days beginning in mid-November to hear the cases, ACLU attorney Allen Lichtenstein said on Monday.

After being held all night in Beatty, the eight were released after a hearing at 1 p.m. Monday. They participated in a demonstration on Sunday involving about 20 people.

The ACLU is representing the protesters because there are constitutional issues that need to be resolved, ACLU Executive Director Gary Peck said.

The demonstrators were charged with obstruction because some of them refused to give their names to Nye County sheriff's deputies, Peck said.

A 9th U.S. Circuit Court of Appeals decision handed down in February in the case of Carey vs. the Nevada Gaming Commission overturned that requirement, Peck said.
