Government alleges Las Vegas worker discriminated against

Home improvement giant Home Depot U.S.A Inc. failed to promote a Las Vegas department supervisor to the job of assistant manager because of his race, the U.S. Equal Employment Opportunity Commission alleges in a lawsuit filed Monday.

The Atlanta home improvement retailer, which has nine Las Vegas stores, was accused of repeatedly failing and refusing to promote Roderick Birdis -- who is black and whom the government said was qualified for the promotion.

The EEOC wants a court order requiring Home Depot, which allegedly promoted less qualified white applicants for the position, to promote Birdis with back pay plus interest and institute policies and programs that provide equal employment opportunities for black employees.

Home Depot officials could not be reached for comment on the lawsuit.
