Man faces charges in attack with bat

Monday, Nov. 11, 2002 | 9:14 a.m.

A 38-year-old Las Vegas man is facing felony charges of striking his girlfriend and 14-month-old son in the head with a baseball bat in August.

According to an indictment unsealed Friday, Brian Scott Warner will be arraigned Wednesday on five charges including several charges of battery with use of a deadly weapon and child abuse and neglect, causing substantial bodily harm.

Deputy District Attorney Steve Waters said Warner and his girlfriend got into an argument in their Las Vegas home Aug. 1.

During the argument, the girlfriend was struck in the head with the bat and rendered unconscious, Waters said.

"When one of the roommates jumped in to prevent her from being injured more, there was a struggle for the bat and the baby was struck in the head with the bat," Waters said.

The baby boy spent several days in the hospital with a fractured skull and his mother sustained numerous bruises over her body and a bump on the head, Waters said. The roommate also was struck with the bat.

Warner, who will be appointed an attorney on Wednesday, spent six months in jail last year on a battery charge involving the same girlfriend, Waters said.

A warrant was issued for Warner and a $100,000 bail was set.

His case has been assigned to District Judge Lee Gates.
