CARSON CITY -- A Laughlin casino cannot be held liable for one of its customers who grabbed a woman patron on the buttocks and injured her in 1996.
The Nevada Supreme Court last week refused to reinstate a suit against the Riverside Resort & Casino, which was accused of negligence by Kim Dung La Due.
She said the Riverside breached its duty to protect her from a casino patron who grabbed her buttocks, causing her injury.
La Due notified casino security, which called the police. She later filed suit against the other patron and the casino.
District Judge Jack Lehman granted a pre-trial summary judgment in favor of the Riverside. In upholding the Lehman ruling, the court said, "A proprietor is not an insurer of a patron's safety."
