Seizure of Binion’s assets OK’d

A state judge today granted a request by Fremont Street Experience LLC to have more than $1.9 million in Binion's Horseshoe's assets seized as security for alleged unpaid membership fees owed to the downtown Las Vegas promotion district.
But Clark County District Judge Gene Porter ruled that the writ of attachment -- a document that allows the Clark County sheriff to seize funds to secure an unsecured claim -- will not be enforced for 14 days to give Binion's an opportunity to file an appeal with the Nevada Supreme Court.
Fremont Street, which said it has been trying unsuccessfully for more than a year to recover past assessments since 1998 as well as current monthly dues from Binion's, said it took legal action in August only after funding shortfalls forced the cancellation of three summer and fall events.
