Fed complaint filed against apartments

A downtown apartment complex is facing a fair housing lawsuit filed by the Justice Department, alleging discrimination on the basis of race, disability and family status.

Residents of the Bonanza Springs Apartments, 600 E. Bonanza Road, filed complaints with the Department of Housing and Urban Development in April alleging that the complex manager and the owners of the complex, Temple 1991 Revocable Trust d/b/a Bonanza Springs Apartments, were harassing them.

The complaint filed in U.S. District Court Friday alleged that black residents were asked to move from apartments in a courtyard area around a pool to apartments along the outside of the complex facing U.S. 95. The complaint also alleges that the defendants refused to rent to families with children and told black applicants that no apartments were available when there were openings.

One man, a wheelchair-bound resident, said he was given a third-floor apartment despite first floor units being available.

The HUD complaints were forwarded to the Justice Department as part of the investigation into the alleged discrimination.

Telephone calls to Bonanza Springs management were not immediately returned this morning.

The suit seeks monetary damages for victims, as well as payment of a civil penalty.
