Lawsuits settled against developers, contractors

Two construction defect lawsuits filed in Clark County District Court involving more than 120 Las Vegas homeowners against several developers and contractors were settled in recent weeks. The homeowners won about $6.4 million.

Fairway Villas Property Owners Association sued Shulman Development Corp. of Nevada, Bramble Development Group Inc., Fairway Ltd. Partnership, NAM II Corp. and First Republic Bank on March 6, 2000, alleging defects in 59 units of its 70-home development at Commerce Street and Washburn Road in North Las Vegas.

Fairway Villas attorney Jeffrey Kerrane, who said the defects included window leaks and stucco cracks, said the case was settled in early August for about $1 million.

Rock Springs Vista 7 Homeowners Association, which sued Rock Springs Vista Development Co., J.A. Black Construction Co. Inc. and its owner James A. Black, Cedar Roofing Inc., H & H Plumbing, Nevada Gypsum Floors, ESP Corp., DL Peterson & Sons Inc. on June 13, 2000, settled the case by agreeing to accept about $5.4 million.

The suit, which was settled in late July, alleged defects including plumbing, roofing and window leaks in more than 60 units of Rock Springs' 244-unit condominium development at Rock Springs Drive and Cimmaron Road in Las Vegas.

David Lee, attorney for the defendants in both lawsuits, could not be reached for comment on the settlements.
