Jury awards $4 million in malpractice case

A Clark County jury Thursday awarded a Las Vegas couple $4 million after a weeklong medical malpractice trial.

According to court documents, Josephine Fasolini filed a lawsuit against Dr. Deborah Gold in July 2000 after undergoing gynecological and urological surgery in March 1997.

Dr. Sheldon Freedman performed a bladder suspension procedure on Fasolini while Gold did the gynecological procedures.

In her lawsuit, Fasolini alleged that Gold "in performing her portion of the surgery removed an inexplicably large amount of vaginal mucosa" resulting in Fasolini's inability to have sexual relations as well as physical and emotional pain.

Gold filed a lawsuit against Freedman alleging he was responsible for Fasolini's problems, but that lawsuit has been suspended while a state medical board reviews the case.

Gold's attorney, Art Tuverson, told jurors Freedman was to blame, but the jury rejected that idea.

The jury awarded Fasolini $3 million for past and future damages and her husband James, $1 million.
