Henderson condominium owners win $6.4 million in defect settlement

Serenade Homeowners Association of Henderson agreed Friday to settle a construction defect lawsuit it filed in 1999 against its developer, Falcon Construction Services Inc., for $6.4 million.

Serenade sued Falcon in Clark County District Court in 1999, alleging its 180-unit condominium complex at 1851 Hillpoint Road "lacked structural integrity and safety," had "defective plumbing, HVAC systems, electrical and fire safety features" and had sustained "water intrusion and damages."

But Falcon, in court papers filed November 1999, denied Serenade's allegations and in turn, accused more than 30 subcontractors of shoddy workmanship.

In Friday's settlement, four of Falcon's insurers agreed to pay $3.45 million of the settlement, while the subcontractors agreed to take responsibility for the remaining $2.95 million.

Falcon could not be reached for comment on the settlement.
