CARSON CITY -- The Nevada Supreme Court has rejected the claim of a woman who said she was injured while being evacuated from her 32nd floor room at Fitzgeralds Hotel and Casino in Las Vegas during a fire in June 1998.
Ofelia Bonnett claimed the resort was negligent and that led to her injuries to her ankle, throat and lungs. She and her husband Luis Bonnett Sr. sought damages from the hotel.
The court said the verdict of the Clark County jury "is supported by substantial evidence and is not clearly erroneous." It said, "The jury could have reasonably concluded from the evidence presented to it either that there was no breach of duty, or if there was, that breach did not cause the Bonnetts' injuries."
The husband claimed he suffered a loss of consortium due to his wife's injuries.
