Exterminator sues former employees

Orkin Exterminating Co. Inc. sued two former employees, alleging they breached a two-year non-compete agreement when they allegedly solicited Las Vegas clients of Orkin.
Orkin sued Rick Lugo and Steven Shoemaker doing business as Bioguard, a pest control company, in Clark County District Court, alleging it lost many regular customers when they used Orkin's customer lists and pricing information and allegedly offered pest control services at prices far below Orkin's prices.
The suit said Lugo was hired by Orkin in June 1998 and resigned on July 15, and that Shoemaker was hired in May 1994 and left in October 1999. It seeks an order to stop them from engaging in the pest control business for two years in Clark and Nye counties.
But Shoemaker denied the charges. "Neither Lugo nor myself have solicited Orkin's customers. When a technician leaves, a lot of times there are a few individuals he had been servicing that continue to call our employees even after they've left Orkin."
