Gaming trademarks at issue

Las Vegas gaming figure Jack Binion sued to stop a Wichita, Kan., man and his two companies from using the Binion Horseshoe trademark to offer online gaming services.
Binion, who is secretary of Horseshoe License Co. and chief executive of Horseshoe Gaming Holding Corp., accused Todd Ash and two alleged Wichita, Kan.-based companies, Ash Investments and midwestyardsale.com, of "cyberpiracy" in a U.S. District Court lawsuit.
Jack Binion, who is brother of murdered casino executive Ted Binion and of Becky Behnen, the current owner of Horseshoe Club in downtown Las Vegas, said he owns the trademark Jack Binion's, while Horseshoe Gaming owns the domain names Horseshoe.com, Horseshoe.org, Horseshoe.net, Horsehoe.com, Horsehoe.net and Horsehoe.org.
The suit said the defendants registered and used the binionhorshoe.com and binionhorseshoe.com domain names to redirect to Go2Jackpots.com, a gaming website allegedly operated by Fast2net.com Inc.
Ash could not be reached for comment on the charges.
