Vegas auto dealer fights state fine

GMF Motors Inc. of Las Vegas is fighting a $1,250 fine it said was erroneously imposed by the state Department of Motor Vehicles and Public Safety.

The DMV levied the fine on Jan. 8 after GMF allegedly failed to provide Michael Mendoza, a lessee of a car, with evidence of compliance with emission standards.

The DMV said Mendoza had to file complaints with the state Consumer Affairs Division and Compliance Enforcement Division after GMF refused to refund him his downpayment after the car couldn't be registered because it didn't have the relevant smog test documents and needed repairs.

But GMF, which claims it presented an adequate defense on May 2 that should have substantially reduced the fine, said Administrative Law Judge David Schreiber, "erroneously determined GMF's contention lacked merit factually and legally."
