Salon appeals decision in favor of Caesars Palace

Scissors Palace, a Las Vegas beauty salon that was ordered by a federal judge to stop infringing Caesars Palace's trademark and operating under that name, has asked for an emergency stay of the order to protect its business pending an appeal.

The salon, which is required by an April 4 court order to destroy all labels, signs and advertisements bearing the mark 'Scissors Palace' by May 5, has appealed to the 9th U.S. Circuit Court of Appeals.

James Jackson, Scissors Palace's attorney, said in an affidavit that salon owner Danny Zach sought the emergency stay because he "would be forced to replace three signs, spa and salon service pamphlets, business cards, business stationery and already placed advertising prior to the determination of the appeal at a minimum cost of about $60,000."

Jackson said these costs "do not cover other potential losses such as customers, employees and attempting to recapture both old and new clients as a result of the name change."
