Ruffin sued over ads

The parent company of Las Vegas' Polo Towers and the Jockey Club is seeking an injunction to stop the New Frontier hotel-casino and two other Las Vegas companies from leasing casino space to any third party that wants to promote time share ownership.

Diamond Resorts International LLC, formerly known as International Resorts Group Inc., sued Ruffin Gaming LLC doing business as the New Frontier, ASNY Co. LLC and Consolidated Realty Inc. in Clark County District Court, alleging the defendants breached an agreement for Diamond Resorts to exclusively advertise time shares at the northeast entrance of the casino.

Diamond Resorts also accused the defendants of libel when they published a letter allegedly issued by Lynn Rutledge, the defendants' attorney, that allegedly accused Diamond Resorts of illegal activity. The suit said the letter was allegedly sent to "non-privileged third parties including Shirley Penzel of the Nevada Department of Business and Industry's Real Estate division."

Diamond Resorts, which didn't describe the illegal activity in its lawsuit, denied the defendants' accusations.

Rutledge declined comment.
