LV property owners in dispute with real estate agent

The owners of a Las Vegas retail and commercial property sued two real estate companies, alleging they mismanaged, embezzled funds and failed to maintain the property.

Martin Stern Jr. and his wife, Chantal, who own Butterfly Square at 557 E. Sahara Ave., sued their property manager, Jack Super, doing business as Super Commercial Realty and Super Realty, and his son, Benjamin, in Clark County District Court.

The Sterns, who said they hired Jack Super to procure tenants, maintain repairs and day-to-day operations of the business center, alleged they recently learned he had charged expenses to Butterfly Square for work done at his personal property.

The suit also alleged Super caused "tens of thousands, if not hundreds of thousands of dollars of checks to be cashed to him ... in his own name"

Jack Super, who said he left the property in February, denied the allegations.

"The Sterns owe me $60,000 in leasing commissions and they've refused to pay that," he said. "They were bleeding the property by taking out $7,500 per month even though it isn't generating as much ... All the expenditures I made were on behalf of the property."

The suit said Jack Super's broker license was suspended for alleged inappropriate and unethical violations including "repeated acts of embezzlement, theft, mismanagement and breach of fiduciary obligations" to the Sterns and Super's other clients.

Jack Super disagreed. "It wasn't a suspension. My broker's license was downgraded to salesman."
