McCabe withdraws Supreme Court appeal

Steven McCabe was found delinquent in March 1998 for the scheme and served eight months at the Caliente Youth Center. He currently is on parole.
Lyon County deputy district attorney Eileen Barnett said McCabe's withdrawal of appeal closes the case because another appeal can't be made.
McCabe's lawyer, Mark Jackson, still believes there were errors at trial that provided sufficient grounds for an appeal including his contention that McCabe was charged under an unconstitutional statute.
But he concedes that even if the appeal were granted it probably would mean another trial.
"He doesn't want to relive it. He wants to get this behind him," Jackson told the Reno Gazette-Journal.
McCabe was arrested at the high school in December 1997 after another student told authorities of the teens plot to take the student body hostage during a planned holiday assembly in the gymnasium.
Investigators said they found written details of the plan, lists of teachers and students who would be killed or spared and several boxes of ammunition in McCabe's locker.
Although the boy didn't bring any weapons to school, the ammunition his locker matched weapons found at McCabe's home.
