Letter: Associations will prevail

Wednesday, May 3, 2000 | 9:46 a.m.

Schneider, during the 1999 Legislature, had laws passed governing associations that are very expensive and believed by many to be unconstitutional.

He tried to pass laws making board members take college courses and sign documents swearing that they have read and fully understand the associating documents and all state laws governing associations, while legislators and lawyers cannot agree on their interpretation. This bill was watered down but still exists.

Schneider is already giving interviews in which he claims associations are bankrupt, having secret meetings and hiding financial reports. NRS 116 already covers these actions.

He is saying, and I quote, "We have quasi-governmental agencies that are out of control. Some do work well, but I have a theory that very good homeowners association will eventually go bad." This statement is belittling and insulting to a vast majority of association members. Is your theory true of legislators and builders, senator?

If homeowner associations are so bad, senator, why not ban builders from creating them?

If associations and their members want to protect their rights and overturn the intrusive, expensive and unconstitutional changes to the law passed in 1999, they will have to join together as one.

Since the state estimate is that there are 1,700 associations in Nevada (which I believe is low), if we work together we will have the ability to get needed laws passed and eliminate the unnecessary and expensive laws.
