Shelby sues over trademarks

Auto racer Carroll Shelby's Shelby American Inc. of Las Vegas said it and Ford Motor Co. sued Factory Five Racing Inc. of Boston, alleging the car-kit maker is infringing on trademarks for Cobra roadsters.

Shelby seeks $10 million in damages and fees in the lawsuit filed in U.S. District Court in Boston.

Shelby also seeks an order to seize and destroy the fiberglass molds that Factory Five uses to make its replicas of the roadsters.

Shelby said the suit is the first of many it plans to file against automakers that make replicas of the car he developed with Ford in the 1960s. Ford owns the trademark for the Cobra and licenses Shelby to make the vehicle.

Officials at Wareham, Mass.-based Factory Five couldn't immediately be reached for comment.
