Battle over $50 costs so much more

Friday, Jan. 21, 2000 | 10:53 a.m.

A UNLV student senator's attempt to recover a $50 filing fee from his re-election bid took him to District Court, where he asked a judge to order the Consolidated Students of the University of Nevada to return the funds.

Aaron Clemens, a 21-year-old pre-law student and Libertarian activist, contended the CSUN executive board improperly declared that he forfeited the funds by not filing a campaign expense report on time.

But District Judge Ron Parraguirre ruled Thursday that Clemens' legal action was premature because he had not obtained an official ruling from the CSUN Judicial Council over the dispute and must do so before seeking the help of the courts.

Although Clemens has contended such a ruling already was made in his favor, Parraguirre determined there had not been a proper order issued, and the judge sent Clemens back for that declaration.

The problem is that in chasing the $50, Clemens had already spent $188 in filing fees to get the case to Parraguirre's courtroom -- only to lose.
