Wal-Mart could file suit if it wants another store

If Wal-Mart wants to build more than the two super centers already approved by a federal judge's order, it will have to file another lawsuit.
Federal Judge Philip Pro last December issued an injunction prohibiting Clark County from enforcing a new ordinance that limits grocery sales and ordered the county to issue building permits for two Wal-Mart stores. On Wednesday he ruled he will not consider the constitutionality of the ordinance.
"One of our options is to file another lawsuit," Wal-Mart attorney Will Kemp said today. That suit likely will raise the same constitutionality issues that were raised in the initial lawsuit so the company can gain approval to build two more super centers, including one in Pahrump.
Pro's recent ruling, Kemp said, will not delay the planned early summer opening of a super center -- a department store that sells groceries -- at 4350 N. Nellis Blvd. and the planned early fall opening of a similar store at 2020 E. Serene Ave.
