A Las Vegas developer sued to force Smith's Food & Drug Centers Inc., a division of Kroger Co., the nation's largest grocery chain, to build a supermarket at a shopping center at Double R Boulevard and South Meadows Parkway in Reno.
In a Clark County District Court suit, American Pacific Capital Village at Double Diamond Co. LLC said it incurred substantial damages when Smith's reneged on an agreement to build a supermarket and parking lot facilities by Oct. 6. The supermarket was to be an anchor business at the Reno shopping center.
Smith's officials declined comment.
