LV woman again accused of being unlicensed

The State Health Division is seeking a second order to stop a Las Vegas woman from operating an unlicensed group home for elderly people and to pay for the transfer of its residents to alternative homes.
The Health Division sued Ana L. Guerra, alleging she violated a first order issued April 20 by Clark County District Judge Gary Redmon that required her to stop operating an unlicensed residential facility at 5625 Birchwood Circle. The Health Division was also awarded $1,000 in civil penalties.
Linda Anderson, the state's attorney, said Health Division investigators found four elderly residents living at the home during their first investigation on March 27 and had them transferred to other homes, and another five residents at their second investigation on July 19.
"The facility is for elderly people who require food, shelter, limited supervision and assistance, and this falls under the definition of a group home and therefore Guerra needed a license," Anderson said.
The Health Division, which alleged Guerra began operating the group home on March 27, is now seeking an order to impose a civil penalty of between $10,000 and $20,000 for Guerra's second alleged offense, according to the state's lawsuit filed in Clark County District Court.
Guerra could not be reached for comment.
