Woman gets plea bargain
Wednesday, Sept. 22, 1999 | 11:25 a.m.
Josephine Moulchin has accepted a plea bargain to charges she was drunk and caused the head-on collision on U.S. 95 that killed a man and left her with injuries.
Although she pleaded guilty to a single felony drunken driving charge Tuesday, it was under a legal provision that does not require her to admit actual responsibility.
Moulchin explained to District Judge John McGroarty that she was in an alcohol-induced blackout during the predawn incident on Aug. 25, 1998, and remembers nothing.
Moulchin's blood-alcohol level was tested after her arrest at 0.22 percent -- more than twice the 0.10 percent that is required to prove drunken driving under Nevada law.
Sentencing is set for Nov. 19 for the woman who has been on house arrest for a year. She faces between two and 20 years in prison and probation is not possible.
