Suit filed over use of girl’s photo in program

A Las Vegas woman sued the Las Vegas Motor Speedway and Speedway Motorsports Inc., alleging they exploited her 6-year-old daughter by using, without her parents' consent, a photo of her in the sale of tens of thousands of Las Vegas 400 race programs.

The plaintiff, Cathy Bowers, is seeking a court order prohibiting the Speedway from selling, distributing and displaying any programs or publications containing her daughter Jordyn's photo.

The suit alleged the defendants had, at the Las Vegas 400 race March 7, sold half of 80,000 copies of a commemorative program containing Jordyn's photograph, which was allegedly manipulated to make it appear as though she was holding a Las Vegas 400 pennant.

The suit alleged the defendants, which it said collected substantial revenue from the sales, refused to compensate Jordyn for the use of her image. It alleged the Las Vegas Motor Speedway had claimed it was entitled to take a photograph of Jordyn and use it in the sale of the programs without parental consent.

"The girl's photo was in the March program that we're no longer selling," said Chris Powell, Speedway executive vice president and general manager. He declined further comment.
