District Attorney Scott Doyle said on Thursday that Nunes was in the wrong place at the wrong time and admitted as much to deputies who responded. He added that there was no argument and no aggressive behavior.
Doyle said there was no special treatment and before making the decision he researched how his office had treated similar situations.
Nunes was arrested at the home of his estranged wife on Monday. He had been permitted at the home over the weekend but was under a temporary restraining order prohibiting contact with her.
