Contractor sued over trust funds

Three glaziers trust funds are seeking a court order to force ACI Distribution of Las Vegas, which they say failed to make fringe benefit contributions to the trusts, to allow them to conduct audits of its payroll and other records for the period starting Aug. 2, 1998, to date.
In a U.S. District Court suit, the trustees of the Glaziers and Glassworkers Pension Trust Fund, Glaziers Health and Welfare Fund and Glaziers Apprentice Training Trust alleged they haven't been able to determine the exact amount of contributions owed because ACI refused to produce documents and information necessary to complete the audit.
The suit said ACI, which allegedly agreed to be bound by the terms of the Master Labor Agreement between the Glazing Contractors' Association of Southern Nevada and the Glaziers and Allied Trades union, allegedly agreed on Aug. 2, 1998, to make the contributions on a monthly basis, and at specified rates for each hour worked by glazier union employees.
The suit said the glazing contractor allegedly agreed to submit written reports to the trusts on or before the 10th of each successive month showing the identities of its employees and the number of hours worked.
"There may or may not be a claim. ... If the audit shows funds are owed, then the legal process will be used to obtain the funds owed," said Kevin Christensen, the plaintiff's attorney.
The defendant could not be reached for comment.
