OSHA files lawsuit, says employee terminated for raising safety questions

The Occupational Safety and Health Enforcement Section of the state Division of Industrial Relations seeks to have the company reinstate Tibor Arlett with back wages and benefits.

Arlett filed a complaint alleging discrimination after being terminated in May 1997. According to the lawsuit, state safety officials concluded the company broke state law by firing Arlett for questioning the safety and health conditions at work, as well as seeking medical treatment after being exposed to asbestos.

Sarah Ralston, a spokeswoman for Circus Circus Enterprises Inc., said she could not discuss specifics of the lawsuit, which the company had not yet seen.

"The company contends that this individual was terminated for reasons related to his job performance," Ralston said.
