Time share resort in dispute over deed
Thursday, March 25, 1999 | 11:35 a.m.
Las Vegas Strip time share resort the Jockey Club and two of its time-share owners sued Troy Cory and a group controlled by Cory in state District Court, alleging Cory and the group filed false deeds against the Jockey Club.
The suit was filed last month by Robert E. and Joan Morris, who own a time-share unit in the Jockey Club; Jockey Condominium Inc., a non-profit corporation that manages the Jockey Club; and Jockey Club Resort Properties, the Jockey Club's owner.
Defendants are Jockey Club Interval Ownership Unit Owners Association, doing business as Jockey Club Alliance Group Against Unfair and Deceptive Business Practices, Jockey Club Alliance Group, Troy Stubblefield Cory, also known as Troy Cory, also known as Keith Alden Whitenack.
According to the suit, Cory controls the Alliance Group, which filed a deed in January 1997 conveying the Jockey Club's title back to itself. However, states the suit, "the Alliance Group did not have an interest in the property to convey to itself or anyone else."
The deed "constitutes a cloud on the Plaintiff's title to the property and a claim to an interest in the property which is adverse to that of the Plaintiff's..."
According to Michael Rawlins, an attorney for the Morrises and the Jockey Club, the Alliance Group deed complicates legitimate owners' attempts to sell or convey their units.
The suit also alleges that Cory and his Alliance Group have acted in the past to complicate the interests of the Jockey Club's time-share owners. In 1996, the Alliance Group sued Jockey Club, alleging Jockey Club management denied Cory access to the company's stock ledger and books. According to the 1996 suit, the Alliance Group is a shareholder organization that owns proxies to shares of Jockey Club stock.
The Jockey Club's February suit says the 1996 suit filed by Cory was dismissed with prejudice.
The Morrises and Jockey Club want the Alliance Group deed declared null and void, and want unspecified damages, costs and fees. Cory could not be located for comment.
