Decision on land owner is upheld

CARSON CITY -- Attorney General Frankie Sue Del Papa said Monday a recent Nevada Supreme Court decision on a Las Vegas condemnation case will save taxpayers millions of dollars.
The court upheld a decision by former District Judge Nancy Becker that prohibited Nicholas and Eleanor LaMonte from seeking compensation for damages to property adjacent to theirs.
The state Transportation Department in June 1995 filed an eminent domain action against the LaMontes to acquire the access from their property to Lone Mountain Road as part of the construction of the U.S. 95-Lone Mountain overpass.
The court action did not require the LaMontes to give up property and their residence retained access to Balsam Street.
The state offered $56,200 for access to the interchange, but the LaMontes sought $465,000 on grounds they had entered into an agreement with the owners of an adjacent property, Ram V. A. and Ram Girijamma Family Trust, to market the two properties.
