After District Judge Joseph Bonaventure refused Thursday to postpone the hearing, defense attorneys for Zane Floyd filed a petition with the Nevada Supreme Court.
The high court took no immediate action on the request.
Floyd's attorneys said they needed more time to challenge the decision of Justice of the Peace James Bixler to permit Las Vegas 1 cable news channel broadcast the preliminary hearing live.
Four Albertson's employees died and one other was seriously wounded June 3 in the early morning shotgun rampage through a local supermarket.
Floyd, a 23-year-old ex-Marine and part time nightclub bouncer, was apprehended as he left the market.
