Judge chides Churchill DA’s office for delay in trial

Judge Archie Blake agreed with the defense lawyer that Deputy District Attorney Chuck Anderson failed to follow a Nevada law that requires giving a list of all witnesses to the defense five days before the trial begins and the names of expert witnesses 21 days ahead of time.
Anderson missed the deadline for the witnesses and for one expert witness.
He offered to remove a doctor from his witness lineup, but Blake ordered the trial delayed.
He said, however, there did not seem to be "any willful noncompliance. It just didn't get done."
Last Wednesday's delay came just before jury selection began and the prospective panel was sent home. The district attorney's office was told to pay for the cost of the delay, including the $9 each potential juror received for showing up and 15 cents for each mile they drove to get there.
The judge set Aug. 25 as the new trial date for Gregory Curtis Dyer, who faces three counts of statutory sexual seduction and three of lewdness with a child under the age of 14.
