Brief: Condo owners sue over defects

The Warm Springs Homeowners Association, which represents owners of 50 condos in a complex on the south side of Warm Springs Road between Eastern and Bruce, filed the suit in state District Court against Warm Springs/Bruce, Diversified Interest Inc., and Diversified Homes doing business as Diversified Development.

A letter filed with the suit said the defects include insufficient drainage of common areas, inadequate fire walls, poor duct work and incorrectly installed wires and plumbing. In some cases, the letter alleges, inadequate sewage pipe installation causes sewer gas smells to vent into condo units.

"There are significant mechanical plumbing problems," said David Pursiano, an attorney for the homeowners.

Warm Springs/Bruce and Diversified officials did not return a call for comment. But Pursiano said Diversified blames its subcontractors for the defects.

"They're going to file a third-party complaint naming subcontractors," said Pursiano.

The homeowners are seeking unspecified damages and fees.
