Restaurant sues to block Strip overpass

Lawyers for the Rosewood Grille said today they are suing the Clark County Commission, seeking to overturn a vote that would allow construction of a pedestrian crossway spanning the Strip between the Venetian and Mirage.

"We told the County Commission during hearings on this issue that we expected to lose millions of dollars because of this," said attorney John Moran Jr.

He and fellow lawyer Sean Huggins were hired by owners of the well-known restaurant, which sits on the east side of the Strip just north of the Venetian.

"The commissioners decided to allow the Venetian and Mirage to place that crossway in the middle of the block, causing a diversion of our customers," Moran said. "It directs people directly into the Venetian, and people on the sidewalk can't access it.

"We believe a recent federal court ruling holding that sidewalks are public, not private, property supports our case."

A spokesman for the Venetian hadn't seen the lawsuit and had no comment.
