Arraignment delayed for men accused in killing

Kelly Eugene Rhyne and James Theadore Mendenhall, both 39, are accused of murdering Donald Wayne "Lobo" Brown, 42, Carlin, last Nov. 1.

The two had been scheduled to be arraigned on Thursday.

A court spokesman said Rhyne and Mendenhall are expected to petition the court at the May 27 arraignment for two writs of habeas corpus, claiming their rights have been violated due to incorrect criminal information presented at their hearing in front of Justice of the Peace Molly Leddy.

An earlier motion to declare Rhyne incompetent to stand trial due to emotional problems was denied by Elko District Judge Michael Memeo.

Rhyne is housed in the psychiatric wing of the Nevada State Prison in Carson City. Mendenhall is being held at Elko County Jail.
