But the court victory won't mean that Beverly Wagner gets her job back.
Police said an arbitrator's decision in March to deny Wagner's appeal of her firing is binding even if she is acquitted of all charges.
Wagner, 38, was arrested Aug. 4 after a minor traffic accident and again 11 days later on a traffic stop.
In the second case, a defense attorney argued that Wagner was not properly advised of her options before the alcohol test.
Wagner's two arrests came after she was disciplined on allegations of coming to work with alcohol on her breath.
