Commission may have violated meeting law

CARSON CITY -- The Las Vegas City Attorney's Office has been asked to investigate a possible violation of the open meeting law by the state Athletic Commission as it discussed the future status of boxer Mike Tyson on Sept. 19.

Attorney General Frankie Sue Del Papa said Monday her office, which usually handles open meeting cases, is bowing out because members of her staff may be involved in the commission's actions.

The request for the investigation came from Thomas Mitchell, editor of the Las Vegas Review Journal. He alleges the commission may have recessed a public meeting and then broke into small groups to deliberate what action should be taken.

He suggested deputies from Del Papa's office acted as couriers between the small groups to arrive at a decision on a course of action. The commission then re-convened and decided to delay any vote on re-licensing Tyson.

At the time, Deputy Attorney General Kirk Hendrick, an advisor to the commission, said there was no violation of the law.

Del Papa turned the case over to Las Vegas City Attorney Brad Jerbic since of the possible conflict in her office.

The commission is tentatively scheduled to meet Oct. 19 on the Tyson matter.
