Washoe District Judge Steven Elliott rejected a request Friday by Chief Deputy Public Defender Jennifer Lunt to throw out charges against Alvaro Mejia Ortiz.
Ortiz is scheduled to go on trial March 16 on a charge he murdered the 4-year-old son of his longtime girlfriend, Ana Isabel Romero, 30.
The boy, Rene Alberto Romero, disappeared in 1994 and has never been found. About the time he disappeared, Ortiz and Romero suddenly moved from Reno to Los Angeles.
Romero has a separate trial set for April 6.
Ortiz could get the death penalty if convicted.
