The Las Vegas gambling figure was scheduled to appear in Municipal Court Thursday on a misdemeanor battery charge.
But the arraignment was rescheduled for Jan. 25 after Chief Criminal Deputy City Attorney Bernard Little said the city was unable to issue a summons to Stupak to appear Thursday.
Stupak's former bodyguard, Ralph Owens, claims Stupak assaulted him Oct. 25 in the lounge of the Thunderbird Hotel. Stupak owns the hotel.
Owens filed a complaint with Las Vegas Metropolitan Police, and the case was then submitted to the city attorney's office for prosecution.
Stupak, a longtime Las Vegas gambling figure, founded the Stratosphere Tower, Hotel and Casino.
