Montana contractor Rick Tabish and one of his employees, Mike Milot, wanted their bail reduced from $100,000 to $15,000.
A justice of the peace granted the request even though Tabish was already out on bail.
The request by Tabish and Milot to get back some belongings that were seized by authorities was turned down.
A third man, Dave Madsen, is also charged in the theft and is out on bail.
A preliminary hearing for the men is scheduled for March.
Binion was found dead in his home on Sept. 17. He died of an overdose of heroin and prescription drug Xanax, but Clark Coroner Ron Flud has classified the manner of death as undetermined.
Two days after Binion's death, Tabish, Milot and Madsen were caught digging up silver bars and coins from an underground vault in Pahrump, 60 miles west of Las Vegas.
Las Vegas police continue to investigate the former casino executive's death.
