Judge’s custody battle stays in Reno court

CARSON CITY -- The battle between District Judge Donald Mosley and his former girlfriend Terry Figliuzzi over their 5-year-old son will remain the province of a Reno judge.
The Nevada Supreme Court on Monday rejected Mosley's request to remove the custody case from District Judge Steven Kosach of Reno.
The high court did, however, intercede in Kosach's handling of the case.
In a 3-2 decision earlier this year, the Supreme Court overturned a Kosach order that would have allowed Mosley to have the boy every other weekend and two weeks of vacation. Instead the court ordered joint custody, as sought by Mosley.
After the decision, Mosley filed another petition saying that Kosach had issued an oral order that prevented him from choosing the school for his son.
In its decision Monday, the Supreme Court said that oral order by Kosach was void because it was issued prior to the final order of the court that directed the parents split custody.
Mosley said the joint custody order, first issued in 1993, allowed him to choose the education for the boy and Figliuzzi to select the religious upbringing. Kosach overturned that order.
In filing his petition two weeks ago, Mosley complained he has been stopped from enrolling his son in the Wasden Elementary School in Las Vegas. Kosach has ruled the child should enter kindergarten at a Boulder City school where he attended day care and preschool.
