Letter: Noncustodial parents will be punished by support hike
Friday, March 14, 1997 | 11:59 a.m.
The Supreme Court of Nevada changed the law regarding sharing equal responsibility for support with the Barbragalo decision, which rewrote the intent of the Legislature regarding child support obligations. Currently, the law states that, if a need can be shown for an increase in child support, it can be brought before the court for justification of the increase above the cap. To increase the cap without justification discriminates against the children and the noncustodial parent.
State policy is to encourage a continuing relationship between the parent and child. The current law penalizes noncustodial parents when they're with their children, which was not the intent of the Legislature. Each parent should be obligated to financially support their children.
