State Retirement Board loses appeal in pension dispute

The high court ruling Tuesday upholds a decision by Clark County District Judge Nancy Becker that gives Woofter about $19,000 more a year in benefits retroactive to his retirement in September 1992.
Woofter, relying on the flawed Retirement Board information, had figured he'd get $67,000 a year in benefits. A proper calculation later showed his benefits should be $48,000 a year.
The Supreme Court said its ruling is based on a stringent standard imposed on the board to give accurate information to people making plans to retire.
The Retirement Board voted 3-2 in September 1993 to deny a request by Woofter for the higher benefits. He then sued and won the lower court ruling, and the board followed up with its appeal to the Supreme Court.
