Letter: People who witness crimes should be treated the same

Doesn't it seem strange that, one year after a man was sentenced to prison for failing to report a crime, the fellow who witnessed a crime in Primm was not breaking the law by failure to report that crime -- until he was recognized on the videotape three days later?
Isn't there something wrong with this picture? Is the judge making his own rules? How is it that, for one person, it is a crime yet, for another, it isn't a crime?
Wish I could get an answer.
